By accessing or using MDM Solutions ("we," "us," "our") services at mdmsolutions.it, or by completing a purchase, you ("Client," "you") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
These terms constitute a legally binding agreement between you and MDMSolutions Company, a US-based S-Corp.
MDM Solutions provides professional website design and development services for local businesses, including:
Services are provided under three plan tiers: Micro, Starter, and Professional. Features and service levels vary by plan as described on our pricing page at mdmsolutions.it/#pricing.
Delivery Timeline: We aim to deliver completed websites within 48 hours of receiving a completed brief. Delivery times may vary based on complexity and volume. This is a target, not a guarantee.
Monthly subscription fees are billed in advance on a recurring monthly basis. Annual/upfront plans are billed as a single one-time payment at the time of purchase.
All payments are processed securely by Stripe. MDM Solutions does not store your credit card information. By providing payment information, you authorize MDM Solutions to charge your payment method for all fees due.
All prices are listed in US Dollars (USD). International customers may see local currency equivalents at checkout, subject to exchange rate fluctuations.
If a payment fails, we will attempt to retry the charge. If payment cannot be collected after reasonable attempts, your service may be suspended until payment is received.
We offer a 30-day money-back guarantee. If you are not satisfied with your website within 30 days of delivery, contact us at hello@mdmsolutions.it for a full refund. No questions asked.
You may cancel your monthly subscription at any time through your client portal or by contacting hello@mdmsolutions.it. Cancellation takes effect at the end of the current billing period. No partial-month refunds are issued for cancellations mid-cycle.
One-time plan purchases are eligible for a refund within 30 days of site delivery. After 30 days, one-time plan fees are non-refundable. One-time plan clients receive 12 months of hosting and portal access from the date of delivery.
Cancellation does not immediately remove your website. We follow a phased wind-down process designed to give you time to transition:

Regardless of cancellation status, you retain full ownership of your website's HTML and CSS files. You may download your complete website files at any time through your client portal while your account is active, or during the 90-day data retention period by contacting hello@mdmsolutions.it.
Upon permanent deletion (day 90), the following data is removed from our systems: your website files, contact form lead records, and your client portal account. Your billing history with Stripe is governed by Stripe's own data retention policies and is not deleted by MDM Solutions. We do not sell or transfer your data to third parties at any point, including after cancellation.
Client owns all website files. Upon delivery and full payment, you receive complete ownership of all HTML, CSS, and asset files that make up your website. You are free to download, modify, host elsewhere, or transfer these files to any developer or hosting provider.

Our websites may include stock photos sourced from Pexels and business data from Google Places API, both subject to their respective terms of use. You are responsible for ensuring all content specific to your business (logos, custom photos, proprietary copy) that you provide to us does not infringe third-party rights.
Website copy and design is provided for your use in connection with your business. MDM Solutions does not warrant that generated content is original or will not conflict with third-party content.
You agree to use MDM Solutions services only for lawful purposes. You may not use our services to create websites for:
MDM Solutions reserves the right to refuse service, terminate accounts, or take down websites that violate these acceptable use standards, without refund.
Our websites are created using advanced technology and automated tools. By using our service, you acknowledge:
We offer revision requests as part of your plan to address any inaccuracies.
MDM Solutions strives to maintain high availability for all hosted websites. However, we do not guarantee 100% uptime. Planned maintenance, infrastructure updates, or third-party service interruptions may cause temporary unavailability.
We are not liable for any losses arising from website downtime, regardless of cause. For mission-critical availability requirements, we recommend the Professional plan which includes priority support.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MDM SOLUTIONS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
Our total liability to you for any claims arising from these terms or our services shall not exceed the total fees paid by you to MDM Solutions in the 3 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you.
MDM Solutions makes no warranty that your website will generate leads, increase revenue, or achieve any specific business outcome. Website performance depends on many factors outside our control.
Your use of MDM Solutions services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We collect and process personal data as described in our Privacy Policy in accordance with applicable data protection laws, including where applicable the California Consumer Privacy Act (CCPA) and the EU General Data Protection Regulation (GDPR).
MDM Solutions reserves the right to modify these Terms of Service at any time. We will notify active clients of material changes via email at least 14 days before they take effect.
Your continued use of our services after changes take effect constitutes acceptance of the updated terms. If you do not agree to updated terms, you may cancel your subscription before they take effect.
These Terms are governed by the laws of the United States. Any disputes shall be resolved in US courts of competent jurisdiction.
